Under the Passenger Transportation Act, the Registrar of Passenger Transportation has the authority to impose administrative penalties solely against the holder of a passenger transportation licence (“licensees”). This is in recognition of each licensee’s responsibility to exercise oversight over the operation of their commercial passenger vehicles. The Registrar has developed an Administrative Penalty Framework (APF) to guide the implementation of these administrative penalties.
The Administrative Penalty Framework has two parts:
- PART 1 -- generally deals with matters related to the care and control of the Passenger Transportation licence; under the Motor Carrier Act regime, many of these types of offences were subject to Violation Tickets, but are not "ticketable" offences under the Passenger Transportation Act.
Index of APF Part 1 Offences - (24 KB PDF) is a 3-page document detailing the Offence Overview and relevant Passenger Transportation Regulation section for Part 1, Non Ticketable Offences under the Administrative Penalty Framework.
APF Part 1 Enforcement Actions - (37 KB PDF) is a 13-page document detailing the escalating enforcement actions in response to Part 1 Administrative Penalties.
- PART 2 - responds to those situations in which the operator(s) of the licensees’ vehicles are repeatedly being issued Violation Tickets for those offences which are “ticketable” under the Passenger Transportation Act .
Index of APF Part 2 Offences - (26 KB PDF) is a 2-page document detailing the Offence Overview and relevant Passenger Transportation Regulation section for Part 2, Tickable Offences under the Administrative Penalty Framework.
APF Part 2 Enforcement Actions - (23 KB PDF) is a 3-page document detailing the initial and subsequent enforcement actions in response to Part 2 Administrative Penalties.
